MoCRA is the Modernization of Cosmetic Regulations Act of 2022. It was the first major revision to the cosmetics portions of the Food, Drug and Cosmetic Act since 1938. It improves the safety of cosmetics and grants the FDA additional authority over the cosmetics offered for sale in the United States.
The changes stemming from MoCRA will affect any person or business that makes and/or sells cosmetics. That is cosmetics of any kind, not just “make-up,” but also lotions, creams, lip balm, sugar scrubs, salt scrubs, bath bombs and fizzies, and even soap (if it’s a cosmetic).
On December 23, 2022, President Joe Biden signed the 4,500 page Omnibus Spending Bill. It includes the “Modernization of Cosmetics Regulation Act of 2022” which updates the cosmetic law for the first time in over 50 years.
